LET’S WORK TOGETHER: COMMISSIONS
ART COMMISIONS
You must read and understand these terms before entering into a commission agreement / booking / deal with the artist, Lars Beelzebub. Also before you ask for any form of quotation form. Once you enter into a commission agreement with the artist, it is assumed you have agreed to all terms and conditions.
Wait, what is a commission agreement? This is the discussion, documented via email (or via any other communication service – if by phone, Lars Beelzebub takes notes of the conversation), in which the artist and the client agree to the subject matter and type of commission to be produced, the commission price, the time when the artist is expected to start the art work, and (if applicable) the deadline, early termination circumstances and the (if necessary) rush rate. The commission agreement shall remain on record with the artist, along with any other documents related to the commission and client for at least two years.
After the agreement is documented, Lars Beelzebub will make you an offer. The offer is completely tailor-made for the assignment. He will put the main subjects of the commission agreement plus the prices in a quotation form. This form will be send to you by e-mail. You have to sign this, so Lars Beelzebub can start working on the commission and you will get your sweet sweet artwork!
REQUIRED CLIENT INFORMATION
Email Address: Communication between the customer and Lars Beelzebub, occurs via e-mail (lars@larsbeelzebub.com). You also will receive the quotation form via e-mail.
Phone Number (Optional): Lars Beelzebub might call the client when there is a conflict in schedule, payment, or a breach in the terms of service.
Physical Address (Optional): Lars Beelzebub only needs the client’s address if the artist is shipping an art print or a commissioned piece.
The client is responsible for ensuring that their contact details are true and correct. Either party shall notify the other party in case of change of address prior to such change.
BEFORE WE START
The client must specify the content of their commission to the best of their ability prior to a commission agreement. A complex commission may incur additional preview sketch and illustration fees, to be defined and agreed upon in the commission agreement prior to the start of work.
The client must specify the desired display size of the commission, regardless of whether the commission is completed digitally or traditionally. A large traditional display size may incur additional illustration fees, to be defined and agreed upon in the commission agreement prior to the start of work on the art piece.
If the commission is time-sensitive, a rush rate may be applied, to be defined and agreed upon in the commission agreement prior to the start of the artwork.
The artist has the right to refuse any commission request, without needing to explain the reason.
The artist will not create any depiction of hateful or racist imagery.
The artist reserves the right to stop work on a commission, or cancel a commission request due to poor communication, rude / inappropriate behavior, an inability to effectively communicate in the English and / or Dutch language, or a breach of the terms of service.
If at any point the client has failed to respond to messages or status updates provided by the artist for a period of longer than one month, the contract may be rendered void and further work will require renegotiation.
PUBLICATION OF THE COMMISSION & COMMERCIAL PURPOSE
By commissioning the artist, the client is purchasing the artist’s labor only. The artist retains all rights to the commission, which includes but is not limited to: Distribution, reproduction, use of the commission for artist promotion; or as it applies to new terms of service agreed upon in a commercial purpose commission agreement.
The client may display the commission in profiles / online locations as long as the artist’s name (“Lars Beelzebub”) is prominently displayed along with a link to www.larsbeelzebub.com. Additionally, for any profile / online display of the artist’s commission you must notify the Artist, unless already defined in the commission agreement prior to the start of Work.
Commissions in profile / online displays cannot breach any of the terms written on this page.
The client cannot display a commission in a public space unless the commission is executed under new terms of service agreed upon in a “Commercial Purpose Commission Agreement” (read more about this, below) prior to the start of work. The client must obtain written permission from the artist prior to displaying the commission in a public space if not already defined in the commission agreement; additional fees may apply.
You can always display the commission art piece in your own personal space.
If the commission is for commercial purpose, the artist must be notified prior to the start of work: additional fees may apply. Commercial use of the commission will be decided on a case-by-case basis. There will always be a special “Commercial Purpose Commission Agreement” made and thereafter signed by both parties, before the start of work. So everyone knows exactly what to expect.
If the commission is defined as confidential in the commission agreement, the artist will temporarily delay public display of the image at the request of the client and as defined in the commission agreement until such time the commission agreement specifies public display is permitted. A client may not request the artist to complete a commission without defining the timespan in the commission agreement to eventually allow the artist to publicly display the image.
Under no circumstances may the client submit a commission to any kind of online or offline contest.
PREVIEW & DELIVERY
The client may always request a preview of the commission at any time during the creation process, but may not request changes to the commission after start of work. Unless a change process is agreed upon in the commission agreement prior to the start of artwork. Or when the artist sends a preview of the artwork to the client to check if the agreement is processed correctly. – Some (big) changes, if approved, will require renegotiation of the timeframe and the fee. Some other, mostly small, changes in digital work will be done for free. But remember: a preview of the art-piece does not mean it is finished. Before you ask for changes, first ask the artist “why”: communication is key!
Refunds may only be issued if the client notifies the artist prior to start of work. No refunds will be issued after Lars Beelzebub has started of working on the piece, nor will a refund be issued before or after the start of work if any of these terms of service are breached. Additionally, the artist has the right to revoke access to, and stop work on the commission at any time after the start of the artwork if these terms of service are breached.
The client may not incorporate the commission in another work of art (or another artist’s commission). A take-down notice will be issued in such cases. In this case the client will receive no refund, as these terms of service are violated.
COMMISSION PAYMENT
Unless stated otherwise, Lars Beelzebub requires 40% of the payment up front, before start of work and the rest of the payment to be submitted before the delivery of the commission, unless otherwise agreed upon in the commission agreement / offer.
When the final artwork is complete, a low resolution version will be shared with the client for final approval. By giving final approval the client is agreeing that the commission is complete and the final payment of 60% of the total fee is due.
Once the price is paid in full, the commission will be provided in the form agreed upon.
All prices are expressed in Euro’s (€), and payments are expected to be made as such. The client is responsible for providing the correct amount, equal to the Euro’s amount. Please visit https://www.wisselkoers.nl/valuta for accurate currency conversions.
The Artist’s preferred method of payment is via bank transfer.
Other payment methods can be made available to the Client upon request.
THEN THIS…
The client will not permit any use of the commission or misuse the artist’s name in any way which would reflect discredit on his reputation as an artist, or which would violate the good nature of the commission.
The client may not distribute, reproduce, or otherwise profit from the commission, beyond the resale of the original [in case of traditional art or the purchased print of a digital piece only] commission or as it applies to new terms of service agreed upon in a “Commercial Purpose Commission Agreement”. You may never resell a digital art piece!
The client may not edit, alter, or trace the commission without the artist’s expressed, written permission, or as agreed upon in the commission agreement prior to the start of work.
The artist has the right to pursue damages under the copyright laws, should there exist a violation in addition to a breach of these terms of service.
The client agrees to indemnify artist against any and all claims and expenses, including but not limited to attorneys’ fees and costs, incurred as a result of the client’s unauthorized use of the work under this agreement, including the enforcement of this agreement by artist.
FORCE MAJEUR
Accidents happen, unforeseen circumstances may occur. The artist may delay the completion of the commissioned piece due to matters beyond his control but will make an effort to complete the work as close to the agreed upon deadline as possible. The artist will always inform you if any such circumstances should arise.
